Former FBI Staff Member Asserts Wrongful Termination Over Pride Flag Display
A long-serving FBI analyst has filed legal action stating he was let go on account of having a rainbow symbol within his office space.
According to the former employee, who worked for the FBI for 16 years, the termination in the past months was “improper and biased”.
Legal Action Asserts Constitutional Violations
The legal filing argues that the bureau infringed upon the plaintiff’s free speech rights and initiated retaliatory measures toward him due to participating in protected speech.
The former specialist is requesting a legal ruling to return his position with the FBI.
Information in the Lawsuit
The comprehensive complaint, submitted in a Washington court for the District of Columbia, claims that the plaintiff was dismissed from his training recently for before showing the Pride symbol on his desk.
According to the filing, the LGBTQ+ banner was awarded to the employee to acknowledge his work to promote the FBI’s equality efforts.
Since childhood, my goal has been to serve my country and safeguard public safety together with the talented and committed individuals at the agency,” remarked the former employee.
He further stated, I showed that symbol – which once flew in front of a federal building – not as a political statement, but rather as an emblem of inclusion, unity and equal service.
“These are the values that helped build the FBI strong. Currently it stands as where individuals such as myself face discrimination. I am convinced I was dismissed not because of my person, but what I am: an openly gay individual,” he concluded.
Sudden Termination Just ahead of Finish
Recently, the employee gained admission to the bureau’s agent training academy at Quantico, Virginia, before what he described as “unexpected firing only weeks prior to graduation”.
The complaint further alleges that eventually after Donald Trump’s inauguration, another employee expressed an alleged concern to the overseeing official concerning the display of the LGBTQ+ symbol.
To be safe, the plaintiff sought that the top lawyer for the Los Angeles field office examine whether the exhibition of the symbol was acceptable,” the filing stated.
It further mentioned, The legal officer told the employee that the display of the banner was not against the agency’s standards.”
Informing of Firing
Nevertheless, on the first of October, Maltinsky was notified of his firing.
In a document referenced in the lawsuit, agency head Kash Patel commented, “I have determined that you used improper judgment with an inappropriate display of political signage in your office in your prior role at the L.A. bureau.
Under Article II of the U.S. Constitution, and the laws of the nation, your position with the Federal Bureau of Investigation is hereby terminated.”
Lawyer Remarks
In a statement provided this week, Maltinsky’s lawyer his counsel stated, The government’s wrongful dismissal is part of a larger campaign to purge government departments of employees who may have different viewpoints, or belong to marginalized groups, or those who challenge bias.
His case is not only for him, but also about ensuring the liberties and protections of every government worker.”

The FBI did not provide a statement on the lawsuit.

The case follows another one lodged recently by ex- senior FBI officials that claimed they’d been improperly dismissed.
They stated that Patel claimed he was ordered by the administration to dismiss any official involved in an inquiry into Trump.
Meanwhile, the FBI terminated a nearly three-decade veteran earlier this month following the official allegedly grew upset due to accounts that the agency head had taken a government jet to be present at a match where his girlfriend performed the anthem.
The veteran, an agency staffer since 1998, was dismissed from his role in the FBI’s critical incident response group, which manages major security threats and the bureau’s aircraft.
